1. Acceptance of Terms
By accessing or using Owly.in ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and Owly.in.
2. Description of the Service
Owly.in is a business management platform for Indian freelancers, studios, and service businesses. It provides tools for managing leads, proposals, contracts, GST invoices, projects, and reports — all in one workspace. Features may be added, changed, or removed at our discretion.
3. Eligibility
You must be at least 18 years old and legally capable of entering into contracts under applicable Indian law. By using the Service, you confirm you meet these requirements. If you use the Service on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.
4. Accounts and Access
You must create an account with accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately at hello@owly.in if you suspect unauthorised access
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree not to use the Service to:
- Upload or transmit unlawful, fraudulent, or harmful content
- Violate any applicable Indian or international law or regulation
- Attempt to gain unauthorised access to our systems or another user's data
- Reverse-engineer, decompile, or disassemble any part of the Service
- Send unsolicited communications (spam) via the Service
- Misrepresent your identity or business affiliation
We reserve the right to investigate violations and take appropriate action, including account suspension and reporting to law enforcement.
6. Your Data
You retain full ownership of all data, content, and information you upload to the Service ("Your Data"). By using the Service, you grant Owly.in a limited, non-exclusive licence to store and process Your Data solely to provide the Service to you.
You are solely responsible for the accuracy, legality, and completeness of Your Data — including GST details, client information, and financial records.
7. Fees and Billing
Certain features require a paid subscription. Applicable fees, billing cycles, and plan details are disclosed before you commit to a paid plan. All prices are in Indian Rupees (INR); GST applicability is shown at checkout.
Subscriptions are billed in advance. We do not provide refunds for partial billing periods unless required by law. We reserve the right to change pricing with reasonable prior notice.
8. Intellectual Property
All software, design, trademarks, and content that form part of the Service are owned by or licensed to Owly.in. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it as described here. You may not copy, reproduce, or redistribute any part of the Service without our prior written consent.
9. Third-Party Services
The Service may integrate with third-party services such as payment gateways, SMS providers, and cloud infrastructure. We are not responsible for the availability, accuracy, or practices of third-party services. Your use of such services is subject to their respective terms and privacy policies.
10. Disclaimers
The Service is provided "as is" and "as available" without any warranties, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific business requirements. Nothing in the Service constitutes legal, financial, or tax advice.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Owly.in shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, or business — arising from your use of or inability to use the Service.
Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the three months preceding the claim.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, or for any other reason with reasonable notice. Upon termination, your right to access the Service ceases. We will provide a reasonable window to export Your Data before permanent deletion, unless termination is due to a violation of these Terms.
13. Governing Law
These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Telangana, India.
14. Changes to Terms
We may revise these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
